Terms and conditions

  1. By submitting a nomination via the Website (as defined below), each entrant agrees to be bound by the terms and conditions set out below.
  2. The promotion runs from 9am on 1st December 2017 until 11.59pm on 28th February 2018 (“Closing Date”).
  3. The promotion is open to UK residents aged 18 or over, excluding employees of the Promoter (or any other company within the Saint-Gobain group) (an “Employee”), an Employee’s immediate family, their agents or anyone else professionally connected with this promotion.
  4. To participate in this promotion, entrants must submit the details of their nominated educational college that falls within the criteria set out in clause 5 below (the “College”) via www.grahamcollegerefresh.co.uk (the “Website”) and complete all required details prior to the Closing Date. Entry by any other means will not be accepted.
  5. To fall within the definition of College, the following criteria must be met by the institution that is being nominated:
    1. it must be a Further Education College. No privately funded training providers can enter;
    2. it must be based on the UK Mainland.
    3. it must teach at least two of the following courses:
      1. Level 1 Diploma in Plumbing;
      2. Level 2 Diploma in Plumbing and Heating;
      3. Level 2 Diploma in Installing and Maintaining Domestic Heating Systems;
      4. Level 3 Diploma in Domestic Plumbing and Heating;
      5. Level 3 Diploma in Domestic Plumbing and Heating (Gas Fired Warm Air Appliances;
      6. Level 3 Diploma in Domestic Plumbing and Heating (Gas Fired Water and Central Heating Appliances);
      7. Level 3 Diploma in Domestic Heating;
      8. Level 3 Diploma in Domestic Heating (Gas Fired Warm Air Appliances);
      9. Level 3 Diploma in Domestic Heating (Gas Fired Water and Central Heating Appliances.
    4. Courses must be taught from age of 16 and upwards, the institution must not only be for adults.
  6. Only one entry per individual is permitted. Multiple entries from one College are allowed to enter.
  7. All entries to this promotion have the opportunity of winning the sum of ten thousand pounds (£10,000) towards materials, labour and other project costs to refresh the plumbing & heating workshop space of the winning College (the “Prize”).
  8. What materials will make up the Prize will be as chosen by a representative of the relevant winning College (as defined below) following discussion with the Promoter (subject to availability). The value of the materials making up the Prize will be a discounted price from the VAT inclusive list price of such materials as advertised by the Promoter. The Promoter’s decision on this is final and no correspondence will be entered into.
  9. The Prize will be allocated following a judging process (the “Judging Process”). The Judging Process will involve the following five criteria (each a “Criteria”):
    Criteria: Explanation of Criteria
    Longevity How it will continue to have an impact into the future.
    Level of Need In depth detail of current workshop space should be provided.
    Learners & lecturers How it will benefit & impact those currently completing training at the College and how it will aid the lecturers in their teaching.
    Strength of application/submission The effort and level of detail included in the entry.
    Creativity & Differentiation How will a workshop refresh help you achieve this.
  10. The Judging Process

  11. The Judging Process will take place after the Closing Date. This will consist of a panel made up of both internal representatives from the Promoter and external representatives (the “Panel”) that will awards marks in accordance with the five Criteria (there is a maximum of 10 marks available per Criteria). The Panel’s decision shall be final and no correspondence shall be entered into.
  12. The entrant is the individual submitting the entry. The Prize will be awarded to the winning College and not the entrant. The entrant themselves shall have no claim to the Prize or any part thereof.
  13. Details of the winning College will be available by sending a stamped addressed envelope to Graham College Refresh, Marketing Department, Saint-Gobain House, Binley, Coventry CV3 2TT.
  14. No responsibility can be accepted for lost, damaged or incomplete entries and the Promoter accepts no liability for entries received after Closing Date. All entries through third parties or agents are invalid.
  15. The Prize is not transferable and no cash alternative is available.
  16. In the event of unforeseen circumstances or circumstances outside of its control, the Promoter reserves the right to offer an alternative Prize of equal or greater value.
  17. Accepting a Prize may give rise to a tax liability which will be the winning College’s responsibility.

  19. In relation to this promotion:
    1. Nothing in these terms and conditions shall exclude or limit the Promoter’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
    2. Subject to clause 18a, the Promoter does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by an entrant and/or a winning College howsoever arising from entering the promotion or accepting the Prize whether due to any error, omission or other caused by the Promoter or its employees, agents or others.
    3. Subject to clause 18a, the Promoter is not responsible for any damage or loss caused to an entrant and/or winning College (i) which is not reasonably foreseeable to the entrant and/or winning College and to the Promoter when the entrant and/or winning College agrees to these terms and conditions (which occurs automatically when the entrant participates in this promotion) or (ii) is reasonably foreseeable to the entrant and/or winning College and to the Promoter when the entrant and/or winning College agrees to these terms and conditions but is only indirectly related to the entrant and/or winning College participating in this promotion.
    4. Subject to clause 18a, the Promoter reserves the right to amend any element of this promotion, or foreclose this promotion and cannot be held responsible for failure to deliver for reasons beyond its reasonable control, including but not limited to strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. The Promoter is not responsible for any loss or damage caused to the entrant and/or winning College as a result of any of these occurrences.
    5. The entrant agrees to reimburse the Promoter in respect of any damages or any losses suffered by the Promoter resulting from any claim made by a third party in each case in respect of any matter arising from the entrant’s and/or winning College’s participation in the promotion in breach of these terms and conditions or from the entrant’s and/or winning College’s violation of any applicable law or regulation.
  20. Entrants must ensure that any person or persons whose image has been used in the project entry has given valid consent for the use of their image or has waived any rights they may have in the images, videos or other media submitted. Entrants must also ensure that anyone who is running the College which is being submitted have consented to their college being nominated to take part in this promotion. Failure to provide this consent to the satisfaction of the Promoter may result in the entrant’s and/or the winning College’s disqualification from the promotion and the forfeiture of the Prize. By entering this promotion, you warrant that any information or material which you submit to this promotion will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. The Promoter reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove such information.
  21. In consideration of the Promoter granting entrants a right to enter the promotion, each entrant automatically hereby grants to the Promoter an irrevocable, exclusive, royalty-free, world-wide licence for the full period of copyright to use, alter, adapt or sub–licence such rights to any third party the images, videos or other media submitted by the entrant in respect of the promotion, in any and all media. You agree to waive any moral rights you may have in the images, videos or other media submitted by you. Where relevant, you agree upon the Promoter’s request to assign to the Promoter any copyright subsisting in any entries you make to the promotion. All entries are printed / displayed at the Promoter’s discretion and may be edited for publication.
  22. It is a condition of entry that winners cooperate fully for publicity purposes if so required. By entering this promotion, the entrant agrees for their details and photograph to be included in future publicity material if required. The entrants must also ensure that anyone who is running the College which is being submitted have consented to their details and photograph and details and photographs of the College and the works that will be carried out at the College to be included in future publicity material if required. Failure to provide this consent to the satisfaction of the Promoter may result in the entrant’s and/or the winning College’s disqualification from the promotion and the forfeiture of the Prize.
  23. The Promoter reserves the right to disqualify any entrant and/or select an alternative winner in the event the Promoter believes that any entrant has contravened any of these terms and conditions.
  24. The Promoter’s decision is final and binding and no correspondence will be entered into.
  25. An entrant’s personal data will be used by the Promoter for the purposes of administering this promotion. If an entrant ticks the box at the point of submitting its details to enter this promotion consenting to being contacted by email, SMS or social media, the Promoter (including its group companies and its and their various trading styles (an “Associate”)) or a third party may send the entrant information by email or social media about news, offers, goods and/or services that the Promoter and/or an Associate feel may be of interest to the entrant.   26. English law applies and the exclusive jurisdiction of the English Courts shall prevail.
